Traffic
and Storage
With this statement we indicate our desire to create an environment
to be as open and unrestrictive as the Internet itself. To that end
we offer unlimited traffic and storage. This is based on a statistical
probability based on an average use. As long as this is not abused,
you will not be contacted. All files are intended to be tied to HTML
pages otherwise you may be subject to warning, suspension, or cancellation.
Payment
Prepayment is required on all accounts. All fees are guaranteed for
the payment period once received i.e.; annually. All setup fees are
non-refundable. Credit card orders will be charged automatically to
the card number on file, unless otherwise notified. If the card does
not clear, you will be notified and subject to suspension. Returned
checks will be assessed a $25.00 dollar charge. CoffsAC.com must be
notified in writing to request termination of services.
Cancellation
Cancellation may occur at anytime and be invoked by the customer or
CoffsAC.com. We reserve the right to cancel hosting services at anytime.
Any cancellation by the customer must be in writing and sent via mail.
CoffsAC.com will notify the customer of cancellation only via e-mail.
Legalese
CoffsAC.com requires all use by customers or Resellers be of a lawful
purpose only. We reserve the right to refuse service at anytime to
anyone for any reason. Use of CoffsAC.com servers or bandwidth in
violation of any Federal, State or Local, statute laws or regulation
is prohibited and constitutes grounds for cancellation. CoffsAC.com
does not allow any adult material of any nature. We do not allow sub-hosting
of any kind. Any violation of the above will result in a warning of
violation. If the violation is not ceased immediately the lack of
action will be grounds for termination of your account.
CoffsAC.com's services are intended for the end user only. Customers
cannot sublease, subhost, or give away control of any portion of CoffsAC.com's
resources. Doing so could result in immediate account cancellation.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold CoffsAC.com
harmless from any and all demands, liabilities, losses, costs and
claims,
including reasonable legal fees asserted against CoffsAC.com, its
agents,
its customers, officers and employees, that may arise or result from
any
service provided or performed or agreed to be performed or any product
sold
by customer, its agents, employees or assigns. Customer agrees to
defend,
indemnify and hold harmless CoffsAC.com against liabilities arising
out of;
(1) any injury to person or property caused by any products sold or
otherwise distributed in connection with CoffsAC.com's server;
(2) any material supplied by customer infringing or allegedly infringing
on the
proprietary rights of a third party;
(3) copyright infringement
(4) any defective products sold to customer from CoffsAC.com's server.
Disclaimer
CoffsAC.com will not be responsible for any damages your business
may
suffer. CoffsAC.com makes no warranties of any kind, expressed or
implied
for services we provide. CoffsAC.com disclaims any warranty or
merchantability or fitness for a particular purpose. This includes
loss of
data resulting from delays, non deliveries, wrong delivery, and any
and all
service interruptions caused by CoffsAC.com and its employees. CoffsAC.com
reserves the right to revise its policies at any time. |
